Frequently asked questions
LLC or C-Corp — which is right for us?
If you're raising from US venture investors, a Delaware C-Corp is the market standard. LLCs suit service businesses and holding structures but create pass-through tax complications for non-US owners. We recommend based on your funding plans and tax position, not a default.
Do I need to travel to the US to set up the company?
No. Incorporation, EIN, registered agent and most banking can be completed remotely. We manage the process end-to-end from India.
Is an Indian-owned US parent even permitted under FEMA?
Since the Overseas Investment Rules of 2022, structures where a foreign entity holds an Indian subsidiary are permissible for bona fide business, subject to conditions and filings. We handle the ODI compliance alongside the US setup so both sides stay clean.
What are the ongoing costs of a US entity?
Registered agent fees, state franchise tax, federal and state tax returns, and bookkeeping — a predictable annual budget we quote before you incorporate, so the decision is made with full information.
Can one team really handle both the India and US side?
That is the point of the practice: one coordinated team for Indian FEMA/ODI filings, US compliance through our US-side network, and the transfer pricing that connects the two.
